Retifact.com (“Retifact,” “we,” “us,” or “our”) provides online tools, technology, applications, and related services.

These services may include link shortening, URL management, link tracking, click analytics, traffic analytics, bot detection, geographic and referral analytics, email and newsletter tools, campaign-management tools, advertising and promotional tools, and other digital, marketing, communication, analytics, or business-related services.

References in these Terms to the “Services” include Retifact.com, Retifact-operated tools and applications, and Retifact-hosted functionality made available through or in connection with Sumrria where applicable.

2. Retifact and Sumrria

Retifact may serve as the technology, hosting, analytics, communication, marketing, or service platform for certain tools offered to Sumrria members.

Eligible Sumrria members may access certain Retifact tools through their Sumrria account without creating a separate Retifact account.

Access may be provided through secure links, authentication tokens, account identifiers, signed requests, or other authentication methods.

Eligibility for a particular Retifact service may depend upon Sumrria membership status, membership level, account status, promotional eligibility, service availability, or other applicable requirements.

If a Sumrria account is suspended, restricted, terminated, expires, or is deleted, access to connected Retifact services may also be suspended, restricted, or terminated.

3. Eligibility

You must be legally capable of entering into a binding agreement in your jurisdiction to use the Services.

You are responsible for ensuring that your use of Retifact is permitted under all laws, regulations, contractual obligations, platform requirements, and third-party terms applicable to you.

4. Retifact Tools and Services

Retifact may provide tools and services including, but not limited to:

• URL shortening;
• Smart link creation and management;
• Link tracking;
• Click analytics;
• Unique visitor analytics;
• Referral-source analytics;
• Device analytics;
• Geographic analytics;
• Bot and automated-traffic detection;
• Traffic statistics;
• Campaign tracking;
• Email and newsletter tools;
• Email campaign creation and management;
• Subscriber and contact-list management;
• Email delivery and engagement statistics;
• Unsubscribe and suppression functionality;
• Marketing and promotional tools;
• Advertising-related tools;
• Sumrria-connected member tools;
• Other online business, analytics, communication, and marketing tools.

Features may be added, modified, limited, replaced, suspended, or discontinued as the Services develop.

5. Link Shortener and Smart Link Tracker

Retifact may provide URL-shortening, smart-link, and link-tracking services that allow users to create shortened URLs and review analytics associated with traffic directed through those URLs.

Available analytics may include information such as total clicks, estimated unique visitors, referral sources, device categories, approximate geographic information, dates and times of visits, and estimated bot or automated traffic.

Link analytics are provided for informational purposes and may not always be completely accurate.

Browsers, VPNs, proxies, privacy technologies, security scanners, bots, network configurations, and third-party systems may affect analytics.

6. Prohibited Links and Destinations

Retifact links, redirects, trackers, or other Services may not be used to promote, distribute, conceal, or facilitate:

• Malware, ransomware, viruses, spyware, or malicious software;
• Phishing or credential theft;
• Fraudulent or deceptive websites;
• Identity theft;
• Illegal products or services;
• Illegal drugs or controlled substances;
• Unlawful gambling;
• Exploitation or abuse;
• Threats or unlawful harassment;
• Illegal hate-related activity;
• Copyright or trademark infringement;
• Unauthorized access to computer systems;
• Scams or deliberately deceptive offers;
• Content or activities prohibited by applicable law.

Retifact may disable, redirect, restrict, or remove a URL that we reasonably believe creates a security, legal, fraud, abuse, reputation, or compliance risk.

7. Retifact / Sumrria Mailer

Retifact may provide an email, newsletter, subscriber-list, or campaign-management system for eligible users, including eligible Sumrria members.

The service may be presented as the Sumrria Mailer, Retifact Mailer, or another related service name.

Technical sending configurations may change when reasonably necessary for security, reliability, deliverability, compliance, or operation of the Service.

8. Mailer User Responsibilities

If you use the mailer, you are responsible for your recipients, subscriber lists, email content, subject lines, links, advertisements, offers, claims, promotions, and campaigns.

You must have a lawful basis for sending your messages and must comply with applicable email, advertising, privacy, consumer-protection, and electronic-communications laws.

Where consent or permission is required, you are responsible for obtaining and maintaining that consent or permission.

9. Mailing Lists

You may not upload or use mailing lists obtained through unlawful, deceptive, or unauthorized means.

Prohibited sources include:

• Illegally harvested email addresses;
• Email addresses obtained through hacking or malware;
• Addresses obtained through unauthorized access;
• Lists obtained in violation of privacy or data-protection laws;
• Unlawfully scraped or harvested email addresses;
• Recipient information you have no legal right to use.

Purchased, rented, borrowed, scraped, or third-party mailing lists may also be prohibited or restricted by Retifact or by infrastructure used to provide the Service.

Retifact may reject, restrict, or prohibit a mailing list when reasonably necessary to prevent spam, complaints, fraud, deliverability problems, legal violations, or abuse.

10. Commercial Email Requirements

Users sending commercial email are responsible for complying with applicable commercial-email laws, including the CAN-SPAM Act where applicable.

Users must, where required:

• Use accurate sender information;
• Use accurate routing and header information;
• Not use deceptive or misleading subject lines;
• Properly identify advertising or promotional communications where required;
• Include legally required sender information;
• Include a valid physical postal address where required;
• Provide a clear and functional unsubscribe method;
• Honor valid unsubscribe and opt-out requests within legally required time periods;
• Stop prohibited marketing communications to recipients who have opted out;
• Comply with other applicable commercial-email requirements.

Retifact may automatically include unsubscribe links, compliance notices, sender information, or other required information in messages.

Users may not remove, obscure, manipulate, disable, or intentionally circumvent required compliance information.

11. Unsubscribe and Suppression Rules

Retifact may use suppression systems to prevent further marketing email from being sent to recipients who have unsubscribed, complained, or otherwise should no longer receive applicable messages.

Users may not intentionally circumvent an unsubscribe or suppression system.

This includes deleting and re-uploading an unsubscribed recipient for the purpose of continuing to send that recipient marketing messages.

12. Bounces, Complaints and Deliverability

Retifact may monitor sending activity and indicators such as delivery failures, bounce rates, spam complaints, unsubscribe rates, or other signals relevant to the security and reputation of the mailer.

Retifact may temporarily or permanently restrict email privileges when activity creates excessive complaints, bounces, security concerns, legal risks, deliverability problems, or harm to Retifact, Sumrria, recipients, or sending infrastructure.

13. Email Sending Limits

Retifact may establish reasonable sending limits based upon account status, Sumrria membership level, account history, deliverability, complaints, infrastructure capacity, security, abuse prevention, or other operational considerations.

Limits may include:

• Messages per hour;
• Messages per day;
• Messages per month;
• Maximum subscriber counts;
• Campaign-frequency limits;
• Recipient limits;
• Temporary sending holds;
• Verification requirements.

A service described as free, included, or unlimited does not authorize abusive, unlawful, automated, excessive, or technically unreasonable use.

Reasonable-use, security, infrastructure, anti-abuse, and deliverability restrictions may apply.

14. Affiliate and Promotional Marketing

Retifact may permit legitimate affiliate, promotional, advertising, business, and marketing content when such content complies with these Terms, applicable law, and applicable infrastructure requirements.

Permission to use Retifact does not constitute approval or endorsement of every affiliate program, advertiser, product, service, business opportunity, offer, or campaign.

Users are responsible for ensuring that their advertisements, endorsements, disclosures, affiliate relationships, product claims, income claims, and promotions comply with applicable laws and applicable advertiser, affiliate-network, platform, and program requirements.

15. Advertising and Promotional Tools

Retifact may provide tools designed to assist users with advertising, promotion, traffic, campaigns, analytics, or other marketing activities.

Availability of a promotional tool does not mean that Retifact or Sumrria approves, guarantees, sponsors, or endorses the product, website, business, offer, or opportunity promoted by an individual user.

Users remain responsible for their own advertising content, claims, links, offers, disclosures, and compliance obligations.

16. No Misleading Earnings or Business Claims

Users may not use Retifact to make fraudulent, deceptive, unsupported, or unlawful earnings, income, product, business, or opportunity claims.

Earnings, commissions, survey opportunities, advertising opportunities, affiliate opportunities, marketplace activity, business results, and other income-producing activities may depend upon eligibility, availability, location, individual effort, third-party requirements, market conditions, and other factors.

Retifact and Sumrria do not guarantee that any user will earn money, make sales, receive commissions, obtain customers, generate a particular amount of traffic, achieve conversions, or obtain any specific financial or business result.

17. User Content

You retain ownership of content that you lawfully own and submit through the Services.

By submitting content to Retifact, you grant Retifact the limited rights reasonably necessary to host, store, process, transmit, display, analyze, and otherwise handle that content for the purpose of providing, securing, maintaining, and operating the Services.

You represent that you have all rights, licenses, permissions, and authorizations necessary to submit and use your content.

18. Intellectual Property

Retifact’s software, interfaces, branding, designs, databases, functionality, graphics, systems, and proprietary technology are protected by applicable intellectual-property laws.

Sumrria names, branding, designs, software, content, and related materials remain the property of their respective owner or owners.

These Terms do not transfer ownership of Retifact or Sumrria intellectual property to users.

19. Acceptable Use

You agree not to:

• Use Retifact for unlawful purposes;
• Send spam or abusive communications;
• Send phishing or fraudulent communications;
• Attempt to bypass sending restrictions;
• Manipulate analytics or traffic statistics;
• Generate fraudulent clicks or artificial traffic;
• Use bots or automated systems to abuse Services or rewards;
• Attempt unauthorized access to another user’s account or data;
• Probe, attack, overload, damage, or disrupt Retifact infrastructure;
• Introduce malware or malicious code;
• Impersonate another individual, company, or organization;
• Misrepresent your relationship with Retifact or Sumrria;
• Attempt to circumvent authentication or security controls;
• Forge or manipulate authentication information;
• Resell or redistribute access where not expressly permitted;
• Use the Services in a way that materially harms Retifact, Sumrria, users, recipients, or infrastructure.

20. Security and Authentication

Retifact may use authentication tokens, cryptographic signatures, account identifiers, sessions, security logs, or other technical mechanisms to authenticate users and protect the Services.

Users must not forge, manipulate, share improperly, reverse engineer, bypass, or intentionally misuse authentication URLs, credentials, tokens, signatures, or security mechanisms.

You are responsible for maintaining reasonable security over your own account, devices, credentials, and access.

21. Privacy

Use of Retifact is also subject to the Retifact Privacy Policy.

The Privacy Policy includes information concerning Retifact’s Sumrria-connected services, link analytics, technical information, mailer and subscriber information, email engagement information, cookies and similar technologies, service providers, data retention, security, and applicable privacy rights.

Users of the Retifact/Sumrria Mailer are responsible for ensuring that they have a lawful basis to collect, upload, process, and use subscriber or recipient information submitted through their accounts.

22. Third-Party Services

Retifact may rely upon third-party technology or services to provide some functionality.

These may include hosting, infrastructure, email transmission, security, analytics, geolocation, DNS, APIs, WordPress software, plugins, databases, or other technical services.

Retifact does not control every third-party service and cannot guarantee the continuous availability, performance, security, policies, or functionality of third-party systems.

Certain functionality may also be subject to applicable third-party terms, technical limitations, or acceptable-use requirements.

23. Sumrria Member Benefits and Free Services

Certain Retifact tools may be made available free of charge or as included benefits for eligible Sumrria members.

Such access does not create a permanent entitlement to any particular feature, capacity, sending volume, traffic level, storage amount, provider, technology, or configuration.

Retifact and/or Sumrria may modify eligibility, reasonable-use limits, functionality, availability, or technical requirements where reasonably necessary.

24. Suspension and Termination

Retifact may restrict, suspend, or terminate access to some or all Services when reasonably necessary because of:

• Violation of these Terms;
• Spam complaints;
• Fraud;
• Security threats;
• Phishing;
• Malware;
• Excessive bounce or complaint rates;
• Abuse of resources;
• Unauthorized access;
• Legal or regulatory requirements;
• Violation of applicable infrastructure requirements;
• Threats to Retifact, Sumrria, users, recipients, or third parties.

Serious abuse may result in immediate suspension or termination without advance notice where reasonably necessary to protect users, recipients, systems, domains, infrastructure, or the public.

25. Deleted Links and Accounts

Retifact may disable or remove links associated with deleted, suspended, or terminated accounts.

A previously issued Retifact shortened URL may redirect to Sumrria.com, Retifact.com, an informational page, an error page, or another destination selected by Retifact after the underlying link has been deleted, disabled, or is no longer available.

Users should not assume that a Retifact shortened URL will remain active indefinitely.

26. Service Availability

Retifact attempts to provide reliable Services but does not guarantee uninterrupted, continuous, secure, or error-free operation.

Services may become unavailable because of maintenance, upgrades, software errors, network failures, hosting failures, attacks, third-party outages, technical problems, security concerns, legal requirements, or circumstances outside Retifact’s reasonable control.

27. No Guarantee of Email Deliverability

Retifact does not guarantee that an email will be successfully delivered, reach an inbox, avoid a spam or junk folder, be opened, be clicked, or generate any response.

Email deliverability may be affected by recipient providers, sender reputation, authentication, content, subscriber engagement, complaints, bounces, filtering technologies, security systems, and other factors outside Retifact’s control.

28. No Guarantee of Analytics Accuracy

Click counts, estimated unique visitors, email engagement statistics, geographic information, device information, referral sources, bot classifications, delivery statistics, and other analytics are estimates.

Retifact does not guarantee that analytics are completely accurate or complete.

Privacy software, browser restrictions, email-provider protections, VPNs, proxies, caching, bots, automated security scanners, network routing, and other technologies may affect reported statistics.

29. No Traffic Guarantee

Retifact may provide tools designed to assist with traffic, promotion, link management, advertising, or analytics.

Retifact does not guarantee any particular quantity or quality of visitors, clicks, leads, customers, conversions, sales, subscribers, engagement, or other results from use of the Services.

30. No Earnings or Business Guarantee

Examples, illustrations, projections, statistics, demonstrations, or hypothetical calculations should not be interpreted as promises or guarantees of future results.

Individual results may vary substantially.

31. User Responsibility

You are responsible for your own use of Retifact and for determining whether your activities comply with applicable laws, regulations, contractual requirements, affiliate-program rules, advertising rules, and other applicable requirements.

Retifact does not provide legal, financial, tax, accounting, investment, or professional advice.

32. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RETIFACT AND THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE EXTENT PERMITTED BY LAW, RETIFACT DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, ACCURACY, RELIABILITY, AND ERROR-FREE OPERATION.

Nothing in these Terms excludes warranties, guarantees, or rights that cannot lawfully be excluded.

33. Limitation of Liability

To the maximum extent permitted by applicable law, Retifact, Sumrria, and their respective owners, operators, affiliates, contractors, service providers, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to use of the Services.

This includes, where legally permitted, loss of profits, revenue, commissions, opportunities, traffic, data, email, customers, business, deliverability, reputation, or access to third-party services.

Nothing in these Terms limits liability that cannot lawfully be limited or excluded.

34. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses, damages, liabilities, penalties, costs, or expenses resulting from your unlawful use of the Services, violation of these Terms, campaigns, subscriber lists, advertisements, content, links, promotions, or infringement of another person’s rights.

Where legally enforceable, you agree to indemnify and hold harmless Retifact, Sumrria, and their respective owners, operators, affiliates, contractors, and service providers from third-party claims resulting from such conduct.

35. Fraud and Abuse Prevention

Retifact may use automated or manual methods to detect and investigate spam, fraud, bots, abusive traffic, malicious links, suspicious campaigns, unauthorized access, account misuse, or other prohibited conduct.

Retifact may take reasonable protective action including:

• Blocking or disabling links;
• Stopping campaigns;
• Restricting email sending;
• Temporarily limiting functionality;
• Suspending access;
• Terminating access;
• Preserving relevant records where permitted or required by law.

36. Legal Requests

Retifact may preserve, disclose, or provide information when reasonably necessary to comply with applicable law, valid legal process, court orders, lawful governmental requests, or other legally binding obligations.

Retifact may also take reasonable action to protect the rights, safety, security, and integrity of Retifact, Sumrria, users, recipients, infrastructure, service providers, and others.

37. Changes to the Services

Retifact may modify, update, replace, improve, restrict, suspend, or discontinue features or Services.

Changes may result from product development, security requirements, technical limitations, infrastructure changes, legal requirements, abuse prevention, provider requirements, or business considerations.

Retifact may update these Terms from time to time.

When these Terms are updated, the “Last Updated” date at the top of this page may be revised.

Continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.

Where applicable law requires additional notice or consent, Retifact will provide such notice or obtain such consent as required.

39. Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

40. No Waiver

Failure by Retifact to enforce a provision of these Terms does not constitute a waiver of that provision or any other provision.

41. Entire Agreement

These Terms, together with the Retifact Privacy Policy and any additional rules, policies, or terms presented for a particular Service, constitute the applicable agreement concerning use of the Services.
